1. By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the applicant seeks grant of regular bail in FIR No.296/2025 dated 08.10.2025 registered at PS Crime Branch, Delhi under Sections 22/25/29/8(C)/23 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). 2. Broadly stated, as per prosecution, acting upon a secret information, a raid was conducted at the premises of co-accused Mohd. Abid on 07.10.2025, from where 54,000 tablets of Tramadol Hydrochloride weighing 14.472 kg were recovered. The said co-accused during interrogation disclosed that the said contraband was supplied to him by the present applicant. This is a digitally signed order. 3. Further during the course of investigation, examination of the mobile phone of co-accused Mohd. Abid revealed that it contained WhatsApp chats with a mobile number registered in the name of Ambreen, wife of the applicant, wherein there were photographs of ‘Tramadol Hydrochloride’ tablets. As per the disclosure of the co-accused Mohd. Abid and wife of the applicant herein, the said mobile number was being used by the present applicant. 4. Based thereon, the present applicant was apprehended and then arrested on 30.10.2025. In his disclosure statement, the applicant stated that he attempted to export 41 cartons of psychotropic medicines through one Ankit on the instruction of one Rohit Sadana @ T.S. Sadana. However, when Ankit denied to export the same for want of necessary documents, the applicant sent 40 cartons thereof to the other co-accused but retained one carton which he sent to co-accused Mohd. Abid, from whom it was recovered later. 5.
The investigating agency during the course of investigation also recovered a large quantity of psychotropic medicines, including Tramadol, Alprazolam, Zolpidem and Nitrazepam, weighing approximately 379.15 kg which were concealed in the container of co-accused Vishnu Dutt Sharma containing household goods at the Mundra Port, Gujarat. 6. In these facts, this Court has heard learned counsel for the applicant as well as learned APP for the State, and have also gone through the Status Report and written synopsis handed over by the learned APP and learned counsel for the applicant respectively, which are taken on record, along with the materials on record. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 05/09/2026 at 09:45:59
7. As borne out from the record, the applicant not only supplied one carton containing 54,000 tablets of Tramadol Hydrochloride weighing 14.472 kg to the co-accused Mohd. Abid, from whose possession the said contraband was recovered, but also attempted to illegally export 41 Cartons of the psychotropic medicine to the United Kingdom on the instructions of one Rohit Sadana @ T.S. Sadana, stated to be the mastermind and the principal supplier of the said psychotropic medicines. The applicant also played an instrumental role in sending the remaining 40 cartons of the said medicines to another co-accused Sunil Kumar. So, on more than one occasion, the applicant was found dealing in large/ excessive quantities of psychotropic medicines. 8. Further, as per Status Report, the applicant was also in contact through another mobile number with the co-accused Vishnu Dutt Sharma, from whose container 379.15 kg of psychotropic medicines were recovered at Mundra Port, Gujarat. 9. All the aforesaid show that the applicant was always actively involved in an organised network engaged in trafficking of psychotropic substances dealing in ‘commercial quantity’.
Therefore, the twin conditions under Section 37 of the NDPS Act, which is a major factor for consideration by this Court, while granting regular bail, also kicks in and which the applicant has not been able to satisfy. 10. Additionally, there are CDR connectivity and incriminating WhatsApp chats, including photographs of the contraband, exchanged between the co-accused Mohd. Abid and the applicant through a mobile number registered in the name of the applicant’s wife. Since she herself has categorically stated that the said mobile number was being exclusively used This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 05/09/2026 at 09:45:59
by the applicant, and since there was/ is no estrangement between the applicant and his wife, the same assume utmost significance. 11. Moreover, this Court has also been apprised that the applicant is also involved in another FIR. 12. As such, the present application is dismissed. 13. Needless to say, expression of view(s) on the merits involved, if any, are solely for the purposes of adjudication of the present bail application and shall have no bearing on the overall case/ trial involved.
