This application under Section 483 of the BNSS, 2023 has been filed Page No.# 2/3 by the petitioner, namely, Sri Anand Kumar alias Anand Kumar Mahato, seeking grant of regular bail in connection with Pragjyotishpur Police Station Case No. 165/2025 under Section 109(1)/117(2)/118(2)/3(5) of BNS. 3. On 22/12/2025, the complainant Biswajit Sarma, S/o Anil Sarma, resident of Kalvani Sagar Path, Kahilipara, P.S. Dispur, District Kamrup (M), Assam, lodged an Ejahar at PGR P.S. through I/C, Panikhaiti O.P., to the effect that on 21/12/2025, when the complainant's family was at Hatisila picnic spot for a get-together around 3:00 PM, a group led by Prabhu Mahato and Ananda Mahato, along with their family members and others, attacked the complainant's cousin Rakesh Sharma (Bablu) and Priyanshu Bora with sharp weapons without any reason, attempting to loot and kill the two students. The complainant's driver, Rupankar Barman, took the injured persons to GMCH Emergency Ward. Medical reports indicate that both legs of Rakesh Sharma (Bablu) were broken. 4. CD as called for has been received. 5. On perusal of the CD, particularly the statement of the victim, who suffered fracture of the leg, there is no direct implication of the present petitioner. Having regard to the same and also the fact that the prime accused, Sri Prabhu Mahato, has been granted bail by this Court today in BA 81/2026, the prayer for bail of the present petitioner, Sri Anand Kumar alias Anand Kumar Mahato, is allowed.” 7. Petitioner shall be released on bail of Rs. 50,000/- with one surety of the like amount to the satisfaction of the learned Elaka Magistrate, in connection of the aforesaid case. It is further provided that the petitioner shall cooperate with the investigation and shall not try to influence or intimidate the witnesses. 8. The petition stands allowed accordingly.
