For ready reference, as far as facts are concerned, the Court is referring to the proceedings in CWP No.8107 of 2025, titled Dr. Meena Thakur & others Versus State of Himachal Pradesh & others. 3. By way of CWP No.8107 of 2025, the petitioner has, inter alia, prayed for the following reliefs:- “(i) That the Applicants may be held entitled to initial basic pay of Rs. 18450/- in the pay band of Rs. 10300- 34800 + 5000 Grade Pay as per provisions of Himachal Pradesh Civil Services (Revised Pay) Rules, 2009 with effect from date of their regularization in terms of judgment of this Hon'ble Court as rendered in CWP (OA) 6401 of 2019 titled, "Dr. Sanjay Guleria & Others Versus State of Himachal Pradesh & Others" and CWP (OA) No. 2223 of 2020, "Dr. Vivek Sharma & Others Versus State of Himachal Pradesh & Others" and upheld in LPA No. 90 of 2023, "State Versus Dr. Vivek Sharma & Others" and LPA No. 113 of 2023, "State Versus Dr. Sanjay Guleria & Others" (ii) That the respondents may further be directed to pay all the arrears pursuant to fixation of basic pay at Rs. 18, 450/- in the pay band of Rs. 10300-34800+ 5000 Grade Pay as per Schedule, Fitment Table and provisions of Himachal Pradesh Civil Services (Revised Pay) Rules, 3 2026:HHC:29555 2009 from date of their regularization. (iii) That the petitioners may also be held entitled to interest @ 12% per annum on payable arrears of pay from the date of their regularization. (iv) That the petitioners may also be held entitled to all consequential benefits, including the benefits under the Assured Career etc. Progression Scheme etc.” By way of CWP No.5159 of 2025, the petitioner has, inter alia, prayed for the following reliefs:- “(i) That the Applicants may be held entitled to initial basic pay of Rs. 18450/- in the pay band of Rs. 10300- 34800 + 5000 Grade Pay as per provisions of Himachal Pradesh Civil Services (Revised Pay) Rules, 2009 with effect from date of their regularization in terms of judgment of this Hon'ble Court as rendered in CWP (OA) 6401 of 2019 titled, "Dr. Sanjay Guleria & Others Versus State of Himachal Pradesh & Others" and CWP (OA) No. 2223 of 2020, "Dr. Vivek Sharma & Others Versus State of Himachal Pradesh & Others” and upheld in LPA No. 90 of 2023, "State Versus Dr. Vivek Sharma & Others" and LPA No. 113 of 2023, "State Versus Dr. Sanjay Guleria & Others" (ii) That the respondents may further be directed to pay all the arrears pursuant to fixation of basic pay at DAY Rs. 18, 450/- in the pay band of Rs. 10300-34800+ 5000 Grade Pay as per Schedule, Fitment Table and of Himachal Pradesh Civil Services (Revised Pay) Rules, 2009 from date of their regularization. (iii) That the petitioners may also be held entitled to 4 2026:HHC:29555 interest @ 12% per annum on payable arrears of pay from the date of their regularization. (iv) That the petitioners may also be held entitled to all consequential benefits, including the benefits under the Assured Career Progression Scheme, etc.” By way of CWP No.7155 of 2025, the petitioner has, inter alia, prayed for the following reliefs:- “(i) That the Applicants may be held entitled to initial basic pay of Rs. 18450/- in the pay band of Rs. 10300- 34800 + 5000 Grade Pay as per of provisions of Himachal Pradesh Civil Services (Revised Pay) Rules, 2009 with effect from date of their regularization in terms of judgment of this Hon'ble Court as rendered in CWP (OA) 6401 of 2019 titled, "Dr. Sanjay Guleria & Others Versus State of Himachal Pradesh & Others" and CWP(OA) No. 2223 of 2020, "Dr. Vivek Sharma & Others Versus State of Himachal Pradesh & Others" and upheld in LPA No. 90 of 2023, "State Versus Dr. Vivek Sharma & Others" and LPA No. 113 of 282023. "State Versus Dr. Sanjay Guleria & Others" (ii) That the respondents may further be directed to pay all the arrears pursuant to fixation of basic pay at Rs. 18, 450/- in the pay band of Rs. 10300-34800 + 5000 Grade Pay as per Schedule, Fitment Table and provisions of Himachal Pradesh Civil Services (Revised Pay) Rules, 2009 from date of their regularization. (iii) That the petitioners may also be held entitled to interest @ 12% per annum on payable arrears of pay from the date of their regularization. 5 2026:HHC:29555 (iv) That the petitioners may also be held entitled to all to all consequential benefits, including the benefits under the Assured Career Progression Scheme, etc.” By way of CWP No.8429 of 2025, the petitioner has, inter alia, prayed for the following reliefs:- “(i) That the That the Applicants may be held entitled to initial basic pay of Rs. 18450/- in the pay band of Rs. 10300-34800 + 5000 Grade Pay as per provisions of Himachal Pradesh Civil Services (Revised Pay) Rules, 2009 with effect from date of their regularization in terms of judgment of this Hon'ble Court as rendered in CWP (OA) 6401 of 2019 titled, "Dr. Sanjay Guleria & Others Versus State of Himachal Pradesh & Others" and CWP (OA) No. 2223 of 2020, "Dr. Vivek Sharma & Others Versus State of Himachal Pradesh & Others" and upheld in LPA No. 90 of 2023, "State Versus Dr. Vivek Sharma & Others" and LPA No. 113 of 2023 "State Versus Dr. Sanjay Guleria & Others" (ii) That the respondents may further be directed to pay all the arrears pursuant to fixation of basic pay at Rs. 18, 450/- in the pay band of Rs. 10300-34800 + 5000 Grade Pay as per Schedule, Fitment Table and provisions of Himachal Pradesh Civil Services (Revised Pay) Rules, 2009 from date of their niat regularization. (iii) That the petitioners may also be held entitled to interest @ 12% per annum on payable arrears of pay from the date of their regularization. (iv) That the petitioners may also be held entitled to all consequential benefits, including the benefits under to the 6 2026:HHC:29555 Assured Career Progression Scheme, etc.” 4. Today, learned Additional Advocate General has handed over instructions dated 18.07.2026, received from Director Ayush, Himachal Pradesh. 5. Learned Senior Counsel appearing for the petitioners submits that in terms of these instructions, now the pay fixation as was being prayed for by the petitioners has been done from due date. He submits that in light of this development, the petitions may be disposed of by directing the respondents to extend the benefit of the said pay fixation to the petitioners with all consequential benefits. Learned Senior Counsel besides relying upon the judgments of this Court in CWPOA No.6401 of 2019 and CWPOA No.2223 of 2023. decided on 02.05.2022, has also relied upon a judgment of the Hon’ble Coordinate Bench, recently delivered in CWP No. 3579 of 2025, titled Dr. Raj Kumar and Others Versus State of H.P. and Others, decided on 01.08.2025 and has submitted that in all these cases,the benefit of the initial pay scale @ Rs.18,450/- has has been granted with consequential benefits. Learned Senior Counsel has also referred to the orders passed in the execution petition arising out of CWP No.3579 of 2025 and has submitted that needful has been done in the case of the said petitioners. 6. In light of the fact that now the grievance of the petitioners stands redressed by the Department, these petitions are 7 2026:HHC:29555 disposed of with the direction that the respondent-Authority shall ensure that the consequential benefits which accrue to the petitioners on account of fixation of their initial pay @ Rs.18,450/- is released in their favour expeditiously and preferably within a period of three weeks.
