1. The present writ petition has been filed seeking a direction to the respondents to demolish the unauthorized construction being carried out by respondent no.3 at the property bearing no.U-46, Subhash Park, Solanki Road, Uttam Nagar, New Delhi (‘subject property’).
2. Counsel appearing on behalf of respondent-MCD submits that the subject property has been booked on 1st September, 2026 for unauthorized construction in the form of ground, first and second floor with projection on municipal land. Further, a work stop notice has also been issued to SHO, P.S. Bindapur on 1st September, 2026. 2.1 The aforesaid documents have been handed over in Court and the same are taken on record. 3. Accordingly, the present writ petition is disposed of while directing respondents to take appropriate action in accordance with law.
4. SHO, P.S. Bindapur shall ensure that the terms of the work stop notice are strictly adhered to and no construction is carried out in the subject property.
5. In the event, the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.
6. All rights, contentions and legal remedies of the private respondent no.3/owner/occupier are kept open.
