order dated 07.01.2026 has ordered to refund the amount of fees deposited by the applicant/institution. He also submits that the
order of cancellation of process for issuing NOCs under the Policy of 2022 is arbitrary, illegal and unjustified.
3. Considered the submissions made by counsel for the petitioner and perused the material made available on record.
4. As per the facts, the petitioner is said to have submitted an application for issuing NOC for running two years Animal Husbandry Diploma Course under the Policy of 2022.
5. During pendency of the process for issuance of NOC, the respondents have come out with the amended departmental procedure/guidelines/policy, 2025 for establishment and operation of Animal Husbandry Diploma Institutions. The petitioner cannot claim consideration of its application submitted under the Policy of 2022 as a matter of right and to claim NOC. Once the respondents have framed new Policy of 2025, then all the pending applications are deserve to be remitted back. The respondents have fairly ordered for refund of the fee deposited by the petitioner. After commencement of the new Policy of 2025, the petitioner is always free to make a fresh application as per entitlement under the new policy. In view of the above, the Court finds no merit in this writ petition hence, the same is dismissed.
6. In view of the order passed in the main petition, the stay application as well as pending application, if any, also stand
disposed of.
