Petitioner has filed this writ petition seeking following reliefs:- ‘10.1 That, this Hon’ble Court may kindly be pleased to issue appropriate writ by directing the respondent authorities to release the full pension, Gratuity, Leave Encashment and other pensionary benefits to the petitioner as well as salary of the suspension period and arrears of salary including arrears of 7th Pay Commission and increment 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent no. 3 to conclude the proceedings of case no. 177/2015 within stipulated time. 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent no. 4 to consider and decide the representation submitted by the petitioner within stipulated time. 10.4 Any other relief as deemed fit by the Hon’ble Court.” 2. Learned Counsel for the petitioner submits that petitioner while working on the post of Senior Agriculture Development Officer stood retired from service after attaining the age of superannuation on 31.08.2019. Petitioner was not paid the retiral dues because one departmental 3 / 3 enquiry was initiated against him which was culminated by imposing upon him a minor penalty. He submits that even thereafter, petitioner has not been paid the entire retiral dues, therefore, this writ petition has been filed. 3. Learned counsel for respondent no. 4 submits that after culmination of departmental enquiry, the amount of gratuity due to petitioner has been paid and further remaining payment is already processed and is pending consideration. According to the instructions, entire retiral dues will be paid to petitioner within a period of four weeks. 4. At this stage, learned counsel for petitioner submits that direction be issued to respondent no. 4 to complete the process of computation of entire retiral dues to be paid to petitioner within a specified time. 5. On due consideration of submission made by learned counsel for the respective parties and particularly considering the submission made by learned counsel for respondent no. 4 that the claim of petitioner towards payment of retiral dues is under process, this writ petition at this stage is disposed of directing respondent no. 4 to conclude the process of payment of retiral dues of petitioner, in accordance with law, expeditiously, preferably within a further period of 05 weeks from today. 6. It is for the counsel for respondent no. 4 to intimidate respondent no. 4 about the order passed by this Court. 7. With the aforesaid observation and direction, this writ petition stands disposed of.
