Mr. Anil Gulati would submit that there is arithmetical mistake in SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.02.23 16:22:26 +0530 2 computation of compensation. He would contend that compensation awarded by the learned Tribunal for loss of estate Rs. 15,000/-, funeral expenses Rs. 40,000 and loss of consortium Rs. 15,000/- could not be added while computing total compensation granted by the learned Claims Tribunal. He would pray to rectify this mistake. 2. On the other hand, learned counsel for non-applicants would oppose. 3. Heard. 4. Perusal of computation chart would make it clear that due to mistake sum of Rs. 15,000/- for loss of estate, Rs. 40,000/- for funeral expenses, and Rs. 15,000/- for loss of consortium granted by the learned Tribunal could not be included in the total sum, thus, MCC is allowed and sum of Rs. 70,000/- is added to the figure 12,85,200 and total sum granted by the learned Tribunal would be Rs. 13,55,200/- ≈ 13,55,000/-. 9. Final Compensation 19,20,606 - 13,55,000 = 5,65,606/- Rs. 5,65,606/- 5. Accordingly, judgment passed in MAC No. 1064 of 2019 is modified to extent indicated above.
