ORDER The petitioner apprehends arrest for the alleged offences under Sections 8(c), 20(b)(ii)(B), 29(1) of the Narcotics Drugs and Psychotropic Substances Act, 1985 (in short ‘the Act’) in Crime No.39 of 2026 on the file of the respondent police seeks anticipatory bail. https://www.mhc.tn.gov.in/judis

2. The allegation against the petitioner is that the petitioner and other accused were involved in illegal possession of ganja containing 1.1 Kgs. Hence, the case.
3. The learned counsel for the petitioner submits that the quantity allegedly recovered in this case is only 1.1 Kgs. of Ganja, which does not fall under the category of commercial quantity. He further submits that the petitioner has no previous cases against him. Hence, he prayed that the petitioner may be enlarged on anticipatory bail.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the Ganja recovered is 1.1 Kgs. He further submits that there is no previous cases against the petitioner. Hence, he prayed to dismiss the present criminal original petition.
5. I have given my anxious consideration to the submissions made by the
learned counsel on either side and perused the materials available on record.
6. Though it is true that there are no previous cases pending against the petitioner, the submissions made by the learned Government Advocate cannot be lightly brushed aside. The nature of the offence alleged is grave and has a serious impact on society at large. Hence, granting anticipatory bail in cases https://www.mhc.tn.gov.in/judis
CRL OP No. 5829 of 2026 __________ Page3 of 4 involving narcotic substances, particularly when the recovery is made from the petitioner and other accused, may send a wrong message to society. Considering the nature and gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner.
7. In view of the above, this Court does not find any merit in the present anticipatory bail application. Accordingly, this criminal original petition is dismissed. 12-03-2026 RAP To
