2. The first bail application of the applicant has been dismissed by this Court vide order dated 13.10.2025 passed in MCRC No. 7745/2025. 3. The case of the prosecution is that on the intervening night of 04- 05/06/2025, the deceased Jhadiram Sahu was murdered by setting him ablaze by pouring petrol upon him, when he was sleeping in his house. The FIR was registered, and during the investigation, it was found that the applicant had caused the murder of his own grandfather, Jhadiram Sahu, over the issue of the property dispute. The applicant was arrested on 05-06-2025, and a charge sheet was filed against him. 4. Learned counsel for the applicant would submit that 8 witnesses have been examined out of the 22 witnesses up to 04.12.2025 and none of them have duly supported the prosecution case. The case of the prosecution is based on circumstantial evidence and there is no eye witness in the present case. The applicant is in jail since 05.06.2025 and final adjudication of the case will take its own time, therefore, he has filed the second bail application. 5. On the other hand, learned counsel for the State opposes the submission made by learned counsel for the applicant and have submitted that while considering the first bail application of the applicant, the entire material filed with the charge-sheet has been considered by this Court and there is positive allegation against the applicant that he committed murder of his grand father by setting
3 him ablaze by pouring petrol upon him. Therefore, he is not entitled for bail. 6.
I have heard learned counsel for the parties and perused the material annexed with the bail application. 7. Considering the submissions made by learned counsel for the parties, considering the nature of allegation and the material available in the charge-sheet, further considering that the first bail application of the applicant has been dismissed on merits vide order dated 13.10.2025 passed in MCRC No. 7745/2025 and the trial of the case is going on and 8 witnesses have been examined up till 04.12.2025, I do not find any change in circumstances to admit the second bail applicant of the applicant. 8.
