JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer: "Wherefore, the petitioners pray that this Hon’ble Court may be pleased to: a. Quash/set aside the impugned possession notice dated 22.01.2025 issued by the respondent bank (Annexure-A) and all measures initiated by the respondent bank against the petitioner; - 3 - HC-KAR NC: 2026:KHC:22959 WP No. 8980 of 2025 b. Direct the respondent bank to regularize the petitioners loan account in terms clause 4.2.5 of the master circular of prudential norms on income recognition asset classification and provisioning pertaining to advances; c. Pass such other orders which this Hon’ble Court deems fit and proper, just and fair under the circumstances stated above, in the interest of justice and equity." 2. In the light of the judgment passed by the Hon’ble Apex Court in Civil Appeal Nos.257-259/2022 between Phoenix ARC Private Limited Vs. Vishwa Bharathi Vidya Mandir and others arising out of WP.Nos.35564-35566/2015 dated 27.03.2018, the present writ petition is not maintainable against L & T Finance Limited, which is a finance company. 3. In that view of the matter, this Court is passing the following: ORDER i. Accordingly, the writ petition is disposed of giving liberty to the petitioner to avail the appropriate remedy. ii.
