Petitioners have filed these writ petitions calling in question the legality, validity and correctness of impugned orders dated 07/02/2019 (Annexure P-1 in each of the writ petitions which are similar but separate orders passed on the same date) by which the competent authority has rejected the applications of the petitioners for regularization pursuant to the order dated 19/11/2018 passed by this Court in WPS/5200/2016. 2. Mr. Hemant Kesharwani, learned counsel for the petitioners, would submit that the applications of the petiitoners have been rejected on the ground that petitioners do not have the requisite qualification as required under the Recruitment Rules, 2016 and 9 therefore, they cannot be regularized on the post of Hand Pump Technician, however, they could have been regularized on the post of Hand Pump Helper, therefore, the impugned orders are liable to be set aside. 3. Mr. Rahul Tamaskar, learned State counsel, would submit that since 16 posts of Hand Pump Technician were lying vacant, therefore, the case of the petitioners was considered, however, it was found that they do not possess the requisite educational qualification for the said post as per the Recruitment Rules, 2016 and as such, their applications have rightly been rejected. 4. I have heard learned counsel for the parties, considered their rival submissions made herein-above and perused the record. 5. A careful perusal of the record would show that the case of the petitioners was considered against the 16 vacant posts of Hand Pump Technician and by the impugned orders, the competent authority has clearly recorded a fidning that the petitioners do not have the requisite educational qualification for the post of Hand Pump Technician as per the Rules of 2016 and thereafter, proceeded to rejected the applications of the petitioners, which is absolutely in accordace with law. So far as the 10 contention made by learned counsel for the petitioner is concerned that the case of the petitioners could have been considered for the post of Hand Pump Helper, it has nowhere been brought on record that the post of Hand Pump Helper is lying vacant for which petitioners’ case can be considered. In that view of the matter, I do not find any merit in these writ petitions. 6. Accordingly, these writ petitions are dismissed leaving the parties to bear their own cost(s). Sd/- (Sanjay K.
