By means of the present writ petition, petitioner seeks a direction from this Court to the learned Civil Judge (Senior Division), Laksar, District Haridwar, to decide Application No. 22A1/1, moved under Order VII Rule 11 read with Section 151 CPC in Original Suit No. 02 of 2023, Gurubaksh vs. Smt. Sunita Singhal, within a fixed time frame expeditiously.

It is contended by learned counsel for the petitioner/defendant that the petitioner/defendant in the aforesaid suit filed an application under Order VII Rule 11 CPC read with Section 151 CPC on 31.05.2023. The objection to the said application was filed by the plaintiff/respondent on 17.10.2025, and the case was fixed for hearing and disposal of the said application on
02.12.2025. Since then, the matter has been adjourned several times, and the application is still pending disposal. Hence, the petitioner seeks disposal of the said application.

Having heard
learned counsel for the petitioner/defendant and having gone through the
2026:UHC:338 2 record, especially the order-sheet, this Court is of the view that the petitioner has succeeded in making out a case for expeditious disposal of the said application.

In view of the above, the writ petition is allowed. The learned Civil Judge (Senior Division), Laksar, District Haridwar, is
directed to decide Application No. 22A1/1, moved under Order VII Rule 11 read with Section 151 CPC in Original Suit No. 02 of 2023, Gurubaksh vs. Smt. Sunita Singhal, within one month from the date of production of a certified copy of this order.

Pending application, if any, stands disposed of accordingly.
