JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question order dated 01.10.2018, passed by the II Additional Chief Metropolitan Magistrate, Bengaluru District, in C.C.No.27517/2018, for the offences punishable under Sections 498A, 354, 323, 506 r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the concerned Court in O.S.No.25863/2018 and have settled their dispute amicably by drawing up certain terms and conditions and therefore, they are before this Court seeking quashment of the proceedings by permitting them to compound the offences. The parties have filed a joint memo and the photocopies of the order sheet of the concerned Court and the joint compromise petition before this Court. 3. The joint memo reads as follows: “5. During the pendency of the above suit, the Hon'ble Court had referred the matter before the mediation and the parties have entered into compromise - 4 - HC-KAR NC: 2026:KHC:9396 CRL.P No. 5505 of 2023 before the City Civil Judge in O.S.No.25863/2018 and the same has been filed before the Hon'ble Court on 20-01-2026. The compromise has been accepted before the Court and the terms of the compromise which is produced herewith for the kind perusal of this Hon'ble Court as DOCUMENT NO.1. 6. In-view of the settlement between the parties to the petition, the Respondent No.2 husband Sri. K.Shravana had executed a Registered Release Deed in favour of the Petitioner No.1 and further the Petitioner No.1 had issued a Demand Draft No.623983 dated 01-01-2026, drawn on Canara Bank, in favour of Sri.K.Shravana the husband of Respondent No.2. 7. The Respondent No.2 and the Petitioner No.1 had withdrawn all the allegation made in the complaint and the suit, to put an end to the long litigation. 8. The Respondent No.2 had received a Demand Draft as stated above before this Hon'ble Court today. 9. In-view of the settlement before the Civil Court, the Respondent No.2 has no objection to quash the proceeding as prayed.” In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the joint memo and terminate the proceedings against the petitioners, as the allegations are not against the State. 4. (ii) The order dated 01.10.2018, passed by the II Additional Chief Metropolitan Magistrate, Bengaluru, in C.C.No.27517/2018 and all further proceedings taken thereto, stand quashed.
