Sumit Kumar], instituted under Section 138 of the Negotiable Instruments Act, 1881 [“NI Act”], pending before the learned JMFC-02, Dwarka Courts, New Delhi [subject matter of TR.P.(CRL.) 72/2026], and Complaint Case No. 1968/2026, [Pawan Kumar Lal v. Mr. Kuldeep Rana, learned counsel for the petitioner, submits that both complaints ought to have been instituted before the learned Magistrate having territorial jurisdiction over the West District, Tis Hazari Courts. He further submits that the complaints arise against the same respondent, though in one complaint the respondent is arrayed in his individual capacity and in the other as the proprietor of a proprietorship concern. I am informed that both complaints are presently at the pre- cognizance stage and, consequently, summons have not been issued to the respective respondents. 3. Having regard to the stage of the proceedings and the circumstances set out hereinabove, the petitions are allowed. Complaint Case No. 5264/2026 and Complaint Case No. 1968/2026 are transferred to the Court of competent territorial jurisdiction in the West District, Tis Hazari Courts, Delhi. 4. The transferred matters be listed before the learned Chief Judicial Magistrate, West District, Tis Hazari Courts, Delhi, on 17.09.2026 for further directions. 5.
