For Petitioner(s): M/s.R.Parthiban For Respondent(s): Mr.P.Dhileepan Government Advocate (Criminal Side) ORDER The petitioner apprehends arrest on execution of a Non-Bailable Warrant issued by the learned Sessions Judge Mahila Court, Cuddalore, for the offences under Sections 450, 376 r/w 511 and 302 of I.P.C, pending trial in S.C.No.87 of 2024, in respect of Crime No.71 of 2023 on the file of the respondent police, seeks bail. 2. The petitioner is facing prosecution for the offence under Sections 450, 376 r/w 511 and 302 of I.P.C. The case has been taken on file in S.C.No.87 https://www.mhc.tn.gov.in/judis CRL OP No. 9411 of 2026 __________ Page2 of 4 of 2024 on the file of the learned Sessions Judge Mahila Court, Cuddalore, The petitioner did not appear before the Court regularly and therefore a Non- Bailable Warrant (NBW) was issued. 3. The learned counsel for the petitioner submitted that the petitioner did not appear before the trial Court on 07.03.2026 due to medical issues. However, NBW was issued against the petitioner. Hence, he prayed that the petitioner may be enlarged on anticipatory bail. 4. The learned Government Advocate (Criminal Side) appearing for the respondent strongly opposed the anticipatory bail application and submitted that trial is at the advance stage, and posted for examination of witnesses. Therefore, he submitted that if the petitioner is enlarged on bail, there is every possibility of further delay in the progress of the trial. 5. I have given my anxious consideration to the submissions made by the learned counsel appearing on either side and also perused the materials available on record. 6. Considering the nature of allegations, the submissions made by the learned Government Advocate (Criminal Side) that the case is now posted for examination of witnesses, this Court is of the firm view that if the petitioner is https://www.mhc.tn.gov.in/judis CRL OP No. 9411 of 2026 __________ Page3 of 4 enlarged on bail, there is every possibility of further delay in the progress of the trial. Therefore, this Court is not inclined to grant bail to the petitioner. 7.
