1. By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, petitioner seeks following reliefs:-
“a. Quash and set aside the impugned judgment dated 13.03.2026 passed by the Ld. Principal District & Sessions Judge, East District, Karkardooma Courts, Delhi in Crl. Appeal No. 34/2025;
b. Stay the proceedings in Execution Case No. Ex-Crl 14/2025 pending before the Court of the Ld. JFMC, Mahila Court-01, East District, Karkardooma Courts, Delhi, during the pendency of the present petition;
c. Direct restoration of possession of property bearing House No. 12, Gali No. 4, Kundan Nagar, Laxmi Nagar, Delhi-110092 to the Petitioner, with consequential directions to restore status quo ante as it, existed prior to 20.04.2026, when the locks of the said property were broken pursuant to the impugned orders;
d. Pass such other and further orders as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.”

Court passed the following order:-
“1. Since learned counsel for the petitioner seeks to rely upon the judgment dated 27.03.2018 passed by the learned Single Judge, East District, Karkardooma Courts, in suit no. 6405/2017 as also the registered Will dated 08.08.2019 which, admittedly, were neither forming a part of the records before the learned MM nor the learned Sessions Judge. In fact, they are also not forming a part of the record before this Court as well. 2. As such, he seeks liberty to take appropriate steps by filing an application seeking to bring the same on record. 3. Renotify on 27.07.2026.”

Though learned counsel for petitioner has filed two separate application(s), being CRL.M.A. 21946/2026 and CRL.M.A. 27132/2026, for bringing on record the said documents as also seeking the condonation of delay, however, after some arguments, he seeks to withdraw the present petition with liberty to seek appropriate remedies in accordance with law before the learned Sessions Court as also to make/ raise the same assertions/ grounds as herein in accordance with law. 4. In wake of the above, the present petition, alongwith the pending applications, is dismissed as withdrawn with liberty as prayed for. 5. Needless to say, learned Sessions Court shall proceed to hear the aforesaid application(s) on its own merits, without being influenced by the observations herein.
