In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Baishnabnagar Police Station Case No. 1474 of 2025 dated 04.11.2025 under Section 78 of the BNS 2023 read with Section 12 of the POCSO Act. And In the matter of: Jannat Ali …. Petitioner Md. Wasim Akram Ms. Sabrina Parveen …for the petitioner
Mr. Shiladitya Banerjee Mr. Subhasish Datta
..for the State
Report filed on behalf of the State is taken on record.
Despite service, no one appears on behalf of the de facto complainant.
Heard the learned counsels for the petitioner and the State.
Perused the case diary.
The prosecution case is that the petitioner was stalking and disturbing the 15 years old victim girl over a period of time. He would even stop her way by placing his motorcycle and pull her dress. There are independent witnesses who support the prosecution case.
Considering the above and the incriminating materials available in the case diary, I do not consider that this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioner is rejected.
