Learned counsel appearing for the petitioners submits that the petitioners are the father-in-law and mother-in-law of the deceased. He next submits that there are general and omnibus allegations against them and the deceased has herself consumed the poison on anger, when she was in the field, which is far from her matrimonial house and the person, who has found her in precarious condition, her statement under Section 180 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been recorded, which is the part of the case diary, where she has supported the aforesaid version. He then submits that both these petitioners are suffering from AIDS and to buttress his argument, he refers to Annexure-2 series, which are the reports of National AIDS Control Organization. On these grounds, he submits that anticipatory bail may [2026:JHHC:17539] -2- kindly be provided to the petitioners. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioners are the father-in-law and mother-in-law of the deceased. 5. Considering that the person, who has seen the deceased in precarious condition, her statement under Section 180 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been recorded, which is the part of the case diary and upon query made by her, the victim has stated that she has consumed the poison in anger and further both the petitioners are suffering from AIDS, which prima facie appears to be correct in light of Annexure-2 of the petition, which are the reports of the National AIDS Control Organization, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Koderma, in connection with Chandwara P.S.
