JUSTICE M.I.ARUN ORAL ORDER Petitioner is the neighbour of respondent no.4 and respondent no.4 has put up construction in violation of building bye-laws and the sanctioned plan. This Court on 13.01.2026 passed the following order: "1. Sri Pavan Kumar, learned counsel accepts notice for respondent Nos.1 to 3. 2. Issue emergent notice to respondent No.4 returnable by 18.02.2026. 3. Respondent No.2 and respondent No.3 are directed to carry out inspection of the property bearing No.2 formed out in Survey No.10, Pattanagere Village, Kengeri Hobli, Bangalore South Taluk, presently coming within the jurisdiction of BBMP, bearing PID No. 2265/2598/2346/10/2, Sri Krishna Garden Layout, Hemmigepura, Ward No.198, Bangalore- 560098 to ascertain whether any construction is being put up on the said property. If so, whether any plan sanction has been obtained, whether the construction is being carried on in accordance with the sanctioned plan, if granted. If no plan sanction is granted, they shall ascertain whether the construction is in accordance with the building bye- laws. They shall submit a report as regards each and every violation, if any, in the said construction. - 4 - HC-KAR NC: 2026:KHC:14790 WP No. 535 of 2026 4. In the event of the construction being found to be contrary to the plan sanctioned and/or the building bye-laws, respondent No.2 is directed to ensure that there is no further construction, which takes place on the property. 5. The inspection to be carried out commencing from 10.30 a.m. on 28.01.2026, after issuing prior notice with the acknowledgement from respondent No.4 before that date. 6. The report to be submitted on or before 18.02.2026. 7. If there is any law and order issue, on a request made by respondent No.2, the jurisdictional police are directed to provide police assistance for carrying out the survey and measurement. 8. Re-list on 18.02.2026." 2. Learned counsel for respondent nos.1 to 3-Bruhat Bengaluru Mahanagara Palike (BBMP) now Greater Bengaluru Authority (GBA) has filed a report dated 12.03.2026 and the same is taken on record. Upon instructions, she submits that respondent no.4 has put up illegal construction in violation of the law and the sanctioned plan and action will be initiated to remove the illegal construction. 3. Learned counsel for respondent no.4 is absent. - 5 - HC-KAR NC: 2026:KHC:14790 WP No. 535 of 2026 4. As it is clear from the report of counsel for GBA, respondent no.4 has put up illegal construction in violation of the sanctioned plan, a direction is hereby issued to BBMP now GBA (West Corporation) to initiate appropriate action against respondent no.4 to remove the illegal construction in accordance with law.
