The Commissioner of Howrah Municipal Corporation and the Commissioner of Police, Howrah Police Commissionerate are virtually present before this Court. 2. Mr. Swapan Kr. Datta, learned Senior Counsel appearing for the Howrah Police Commissioner, submits that an incorrect submission was made in Court yesterday that the police have not rendered assistance to the applicant or the Howrah Municipal Corporation to carry out the demolition. 3. A report filed is filed on behalf the Commissioner of Howrah Police Commissionerate stating that for 59 days since July, 23, 2025 till yesterday (14.01.2026), albeit intermittently, police deployment was made at the site. 4. Learned counsel for the Commissioner, Howrah Police Commissionerate submits and the applicant confirmed that all the structures on the land in question have been demolished. 5. Learned counsel for the Howrah Municipal Corporation submits that they have never stated that they were not assisted by the police. 6. It is submitted by the counsel for the club that the Civil Court has not recognized the possession of the applicant. 7. The applicant shall continue to deploy its security guards until final decision in the pending civil suit being Title Suit No. 1064 of 2024 between the club concerned and the applicant. The deployment of security guards by the applicant and the possession of the property shall abide by the result of the civil suit. 8. It is made absolutely clear that there shall be no construction on the property in question by any of the party and the applicant’s possession shall not be disturbed. The Howrah Police Commissionerate shall assist the applicant as when requested and necessary. 9. The directions contained passed by this Court, shall be implemented subject to the result of the civil suit and abide by the same. 2 10. With the aforesaid directions, the instant contempt application shall stand disposed of. Rule, if any, shall stand discharged. 11. The personal presence of the Commissioner of Howrah Municipal Corporation and the Commissioner of Police, Howrah Police Commissionerate is dispensed with. 12. There shall be no order as to costs. 13. The reports of the Commissioner of Howrah Municipal Corporation and the Commissioner of Police, Howrah Police Commissionerate are kept with the record. 14.
