Affidavit of service filed in Court today is taken on record. The petitioners claim to be the owners of plots of land being L.R. Dag No.947 and 948 within Mouza- Purusottampur, J.L. No.24 under Police Station-Egra in the District of Purba Medinipur. The petitioners state that Egra to Contai road maintained by the Public Works Department is running adjacent to the aforesaid property of the petitioner. The petitioners allege that the private respondents have raised a construction by encroaching upon a portion of the land maintained and controlled by the Public Works Department thereby causing obstruction to the ingress and egress of the petitioners from their property to the PWD road. The petitioners claim to have submitted a representation dated January 22, 2026 before the

Executive Engineer, Public Works Department, Tamluk Division. The learned advocate appearing for the petitioners submits that in spite of receipt of such representation, no steps have been taken by such authority till date. Mr. Mahata, learned Additional Government Pleader submits that necessary steps in accordance with law shall be taken by the respondent authorities if an encroachment upon the PWD land is found. Without entering into the merits of the claim made by the petitioners in the representation dated January 22, 2026, WPA 5354 of 2026 stands disposed of by directing the Assistant Engineer, Contai Highway Sub-Division, Public Works Department, being the respondent No.4 to consider the representation dated January 22, 2026 and after causing necessary enquiries and demarcation of the plots in question through competent Amins/Surveryors upon prior service of notice to the petitioners, the private respondents and any other persons, who may be affected by such demarcation and if upon such demarcation it is found that there is an encroachment upon the land belonging to the Public Works Department, the respondent No.4 shall take necessary steps and initiate appropriate proceedings in accordance with law. The entire exercise shall be completed as expeditiously as possible but positively within a period of 12 weeks from the receipt of a

server copy of this order along with a copy of the representation dated January 22, 2026.
