JUSTICE JASMEET SINGH O R D E R % 24.08.2026 1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :- “A. Issue a Writ of Mandamus directing respondent to issued a revised recognition order to the petitioner institute as per the National Council for Teacher Education (Recognition Norms & Procedure) Regulations, 2014. B. Issue a Writ of Mandamus to directing the respondent to add the name of the petitioner institution in the category of recognized institutions and add the name of the petitioner institution in the list of recognized institutions which is uploaded on the official website of the respondent NCTE;…..” 2. This order is being passed in view of a similar order dated 26.09.2022 This is a digitally signed order. Based upon the said order and using the same reasons and expressions, this order is being passed. 3. The petitioner institution was granted recognition on 07.11.2003 by respondent No. 2-Western regional Committee (WRC), NCTE for running a B.Ed. course with an intake of 100 students. The NCTE (Recognition Norms and Procedure) Regulations, 2014 (“2014 Regulations”) were notified on 1st December, 2014 and vide letter dated 24th December, 2014, issued by NCTE to all regional committees, it was communicated that revised recognition order would be issued, provided existing institutions furnish the required affidavit in the prescribed format as given in the ‘Explanatory Note’. Thereafter, the petitioner submitted required affidavit for issuance of revised recognition order in January, 2015 and also on 04.04.2026. However, despite lapse of time, revised recognition order has not been issued. 4. Learned Counsel for petitioner institution states that recognition of petitioner institution continues, but affiliating university is not permitting admissions. The issue raised in the present petition is covered by various decisions of this Court including the decision in Shri Shakuntal Secondary Teachers Training College & Anr. v. NCTE & Anr., W.P.(C) 10970/2020, wherein this Court directed the respondents to decide the petitioners' request for a revised recognition order within a stipulated timeframe. He further submits that until the said request is decided, petitioner institution must continue to be treated a recognised institution for all purposes. 5. He submits that the required documents for issuance of revised recognition order are not on record with the WRC. 6. However, the counsel for the petitioner states that the documents have already been submitted. 7. This Court notes that recognition given to petitioner institution for 100 seats continues to be in operation under the NCTE Act, 1993 and has admittedly not been withdrawn. Accordingly, petitioner institution shall be treated as a recognized institution for all purposes till any contrary orders are passed by respondents, in accordance with law. 8. The petitioner institute is directed to submit the requisite documents within two weeks from today. It is directed that the respondents shall take all consequential steps forthwith including correcting status of petitioner institution on their website, informing the Department of Higher Education, Government of Gujarat and affiliating University/ concerned authority to enable petitioner institution to participate in counselling and admission process for the B.Ed. course. 9. In the meantime, let the respondents decide on the request of petitioner institution for issuance of revised recognition order for B.Ed. course with 100 seats expeditiously, preferably within 6 weeks from today. 10.
