1. Heard learned counsel for the parties.
2. Learned counsel for the appellant, after arguing the matter for some time, on instructions, seeks leave to withdraw the present appeal with liberty to the appellant to apply afresh under the Bihar Privileged Persons Homestead Tenancy Act, 1947 as he claims to be a displaced person as defined under the said Act.
3. Leave is granted with the liberty as prayed for.
4. Learned counsel for the appellant submits that in addition to applying under the abovementioned Act, liberty should also be given to the appellant to avail any other legal remedies as available under the law.
5. This liberty is also granted, subject to the objections that the respondents may have in this regard.
6. The present appeal is accordingly disposed of as withdrawn with the aforesaid liberties.

7. However, all contentions of the parties are left open and no contentions are restricted merely because we have granted liberties.
8. No costs.
