Crl.O.P.No.8160 of 2026 O R D E R The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 420 of IPC in Crime No.389 of 2025 on the file of the respondent Police, seeks anticipatory bail. 2. The allegation against the petitioner is that the petitioner is running a pawn broker shop and had collected 280 grams of gold jewels from the de facto complainant for pledging, and when the de facto complainant came forward to redeem the jewels, the petitioner refused to hand over the same. Hence, this case. 3. The learned counsel for the petitioner submitted that the petitioner has not collected the gold jewels for pledge, but it was an outright sale made in favour of the petitioner. He further submitted that the petitioner is ready to co-operate with the investigation. Hence, he prays for grant of anticipatory bail to the petitioner. 4. The learned Government Advocate (Crl.Side) appearing for the respondent police strongly opposed the anticipatory bail application on the 2/4 https://www.mhc.tn.gov.in/judis
Crl.O.P.No.8160 of 2026 ground that the earlier application was dismissed by this Court on 17.02.2026 in Crl.O.P.No.3496 of 2026, wherein this Court held as follows:
“Considering the fact that the huge quantity of gold jewel has been collected and no proof is produced to show that the petitioner has purchased the property as a outrage sale, this Court is not inclined to grant anticipatory bail to the petitioner.”
5. From the above observation and as rightly contended by the learned Government Advocate (Crl.Side), there is no change in circumstances. Hence, this Court is inclined to entertain the petition. 6.
