The instant MCC has been preferred by the applicant with following prayer: “It is, therefore prayed that, this Hon'ble Court may kindly be pleased to allow the application for modification and may modify the order dated 08.12.2025 passed in M.Cr.C.No. 10006/2025 may kindly be modified and the name of the arguing counsel of the applicant Mr. Navin Shukla may be mentioned in place of Mr. Pragalbha Sharma and may kindly be please to replace the word from Para 3, 4 & 6 of the said order that is charge sheet has been filed to charge sheet has not been filed in this case or as this Hon'ble Court thinks fit and consider, in the interest of justice.” 3. The Registry has submitted its report that the present MCC which has been filed for modification of the order dated 08.12.2025 RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 passed in MCRC No. 10006/2025, is not maintainable, and instead of the same CRMP should have been filed. 4. The counsel for the applicant submits that he has filed the CRMP with the covering memo, but considering the fact that the MCC is not maintainable as has been pointed out by the Registry. 5. Learned counsel for the applicant prays that the instant MCC be dismissed as withdrawn with liberty to move a petition in a proper provision under the Rules of the Court. 6. Prayer is allowed. 7. Accordingly, the instant MCC is dismissed as withdrawn with liberty to the applicant to move a petition in a proper provision under the Rules of the Court. 8.
