This is an application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Motibur Rohman, in respect of PRC Case No. 429/2025 pending in the court of the learned Chief Judicial Magistrate, Sonitpur, Tezpur. The petitioner is an accused before the trial court. He was earlier appearing before the said court but on 30.10.2025, the petitioner was absent without steps. Therefore, the trial court directed to issue NBWA against the Page No.# 2/2 petitioner and accordingly, the petitioner Motibur Rohman was arrested and remanded to custody. I have considered the submissions made by the learned counsel for both the sides. Since the petitioner has been regularly attending before the trial court, he does not deserve to be detained in custody. Hence, the bail prayer of the petitioner is allowed. The petitioner Motibur Rohman, who is in custody in connection with PRC Case No. 429/2025 pending in the court of the learned Chief Judicial Magistrate, Sonitpur, Tezpur, is allowed to go on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Sonitpur, Tezpur.
