JUSTICE SATYAVRAT VERMA ORAL ORDER 2 14-05-2026 1. Heard learned counsel for the petitioner and the learned APP for the State. 2. The petitioner seeks bail in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(1), 191(2), 191(3), 190, 109, 76, 303(2), 352 and 351(3) of the BNS, 2023. 3. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 06.01.2026 and the informant alleges that on 01.01.2025 at 4.00 P.M. while she was sitting at her door when the accused persons including the petitioner came variously armed and started abusing her and thereafter, dashed her on the ground and disrobed her, on which she raised an alarm when her son Arvind Kumar came to save her, thereafter petitioner assaulted Arvind by lathi causing injury on his head, thereafter Rahul Kumar Patna High Court CR. No.28068 of 2026(2) dt.14-05-2026 2/3 assaulted Arvind on his right hand by lathi causing fracture of the little finger and when her husband Jagdish Chaudhary came to save them when Rahul assaulted Jagdish by lathi causing injury on head, further the accused persons also acted inappropriately with her daughter. 4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that informant is own aunt (chachi) of the petitioner since father of petitioner and husband of informant are own brothers. It is further submitted that they reside in the same house and are having dispute relating to property, but then the informant for reasons best known did not disclose the relationship in the FIR rather gave an impression that accused persons had come to her house and committed the occurrence of assault. It is also submitted that from side of the petitioner, Dalmianagar P.S. Case No. 01 of 2025 has been instituted against the informant and others. It is fairly submitted that injury of Arvind has been opined to be grievous, but then petitioner, though, is alleged to have assaulted by lathi, but then blow is not alleged to be repeated and petitioner is not a criminal. It is also submitted that if privilege of regular bail is granted, the petitioner will not abscond rather will cooperate in Patna High Court CR. MISC. No.28068 of 2026(2) dt.14-05-2026 3/3 the trial to prove his innocence. 5. Learned A.P.P. for the State opposes the regular bail application of the petitioner. 6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor court in connection with Dalmiya Nagar P. S. Case No.02 of 2025. 7. Accordingly, the instant regular bail application stands allowed. 8. It is made clear that if the learned Trial Court comes to a conclusion that petitioner, after his release, is trying to delay the trial in any manner, in that event the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
