Order No.05 Dated-18-06-2026
Heard the parties.
The petitioner has been made accused in connection with N.D.P.S. Case No.42 of 2023 arising out of Saiko P.S. Case No. 19 of 2023 registered for the offence punishable under Sections 15(c) and 25 of the N.D.P.S. Act.
Learned senior counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is the owner of the pick-up van which was involved in transportation of 245.70 Kgs poppy straw in 16 bags which comes under commercial quantity. It is next submitted that the allegation against the petitioner is false. It is then submitted that nothing has been recovered from the conscious possession of the petitioner. It is also submitted that the petitioner is also involved in N.D.P.S. Case No. 44A of 2023 arising out of Saiko P.S. Case No. 20 of 2023 in which he has been granted bail. It is further submitted that charge has also been framed in this case on
29.04.2026. It is next submitted that the petitioner has been in custody since 17.10.2025. It is lastly submitted that the petitioner is ready and willing to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned counsel appearing for the State on the other hand
opposes the prayer for bail of the petitioner and submits that keeping in view that poppy straw in commercial quantity has been seized by police in connection with this case which comes under commercial quantity, the rigors of Section 37 of N.D.P.S. Act is attracted in this case and in the absence of any material to be satisfied that there are reasonable grounds for believing that the petitioner is not guilty of the offence or that he is not likely to commit any offence while on bail and also the chance of the petitioner’s absconding and tampering with the evidence, if released on bail as well as the criminal antecedent of the petitioner of being involved in another case of the offences punishable under the penal provision of N.D.P.S. Act.; the petitioner ought not to be released on bail. Considering the serious nature of allegation against the petitioner and in the absence of any reasonable grounds for believing that the petitioner is not guilty of the offence or that he is not likely to commit any offence while on bail as well as chance of his absconding and tampering with the evidence, if released on bail as also the criminal antecedent of the petitioner, this Court is not inclined to admit the above named petitioner to bail at this stage. Accordingly, the prayer for bail of the above named petitioner is rejected at this stage.
