This first anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the applicant, who is apprehending his arrest in connection with Crime No.402/2025 registered at Police Station Gandai, District - Khairagarh-Chhuikhadan-Gandai (C.G.) for the AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN 2 offence punishable under Sections 318(4), 338, 336(3), 340(2), 61(2) of BNS. 2. Prosecution case in brief is that the on 21.11.2025 at about 5:20 PM, a written complaint was submitted by Rajkumar Solanki, Deputy Director (Agriculture)-cum-Secretary, District Level Grievance Redressal Committee, Pradhan Mantri Fasal Bima Yojana, District K.C.G., stating that pursuant to the instructions issued by the Office of the Collector, District Khairagarh-Chhuikhadan-Gandai, an inquiry was conducted regarding fake crop insurance claims in Village Dhodha. During the inquiry, it was allegedly found that the applicant, along with other accused persons including insured farmers, a CHC operator, cooperating farmers, and an insurance company representative, in furtherance of a criminal conspiracy, submitted forged documents and fraudulently obtained crop insurance benefits amounting to more than Rs. 6 lakhs. On the basis of the said complaint, Crime No. 402/2025 was registered at Police Station Gandai against the applicant and others. During investigation, a spot map was prepared, seizure proceedings were conducted, the inquiry report was seized, and statements of witnesses were recorded. The investigation is still pending. Hence, the bail application. 3. It transpires from the bail application preferred on behalf of the applicant that co-accused persons, namely, Khuman Ram Janghel, Devendra Janghel, Mordhwaj Sahu and Sunil Kumar have already been granted by this Court vide orders dated 13.01.2026, 21.01.2026, 22.01.2026 and 28.01.2026 in MCRCA Nos.62 of 2026, 3 112 of 2026, 125 of 2026 and 141 of 2026 and on the ground of parity, the applicant has preferred present bail application. 4. On the other hand, learned State counsel as well as learned counsel for the objector have opposed the prayer for grant of anticipatory bail and submits that allegedly the applicant in connivance with the co- accused persons, fraudulently prepared and submitted forged documents to claim fake crop insurance benefits under the scheme and thereby dishonestly obtained an amount of more than Rs.6 lakhs causing wrongful loss to the Government, but could not dispute the fact that co-accused persons have already been granted anticipatory bail by this Court. 5. I have perused the case diary and the documents appended with the bail application. 6. Considering the facts & circumstances of the case, nature of dispute and material available in case diary, and the fact that though allegedly the applicant in connivance with the co-accused persons, fraudulently prepared and submitted forged documents to claim fake crop insurance benefits under the scheme and thereby dishonestly obtained an amount of more than Rs.6 lakhs causing wrongful loss to the Government, but considering the fact that identically situated co-accused persons, namely, Khuman Ram Janghel, Devendra Janghel, Mordhwaj Sahu and Sunil Kumar have already been granted by this Court vide orders dated 13.01.2026, 21.01.2026, 22.01.2026 and 28.01.2026 in MCRCA Nos.62 of 2026, 112 of 2026, 125 of 2026 and 141 of 2026, as such, without further commenting 4 anything on merits, this Court find it appropriate to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Ramsingh Kashyap, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) He shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) He shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
