JUSTICE HARISH VAIDYANATHAN SHANKAR O R D E R % 01.09.2026 1. The present Petitions, filed under Section 25-B(8) of the Delhi Rent Control Act, 1958 [―DRC Act”], seek to assail the Judgment/Order dated 01.07.2025 [“Impugned Orders”] passed by the learned ARC-02 (Central), Tis Hazari Courts, Delhi [“learned ARC”] in RC ARC 691/2023 and 693/2023 titled as “Yogesh Kapoor And Ors. vs. M/s Wings Wollen & WVG Mills” and “Yogesh Kapoor And Ors. vs. M/s Gurubux Singh & Sons.” 2. Learned Senior Counsel appearing on behalf of the parties, after addressing arguments for a considerable period, submit, on instructions, that the matters may appropriately be remanded to the learned ARC for reconsideration of the entire matter. 3. Learned Senior Counsel for the parties submit that such remand would be warranted in view of certain factual aspects which were not before the learned ARC and which are also sought to be placed and relied upon in the present proceedings, including, inter alia, the proceedings under Section 27 of the DRC Act stated to have been initiated by the Petitioner on a prior occasion, as also certain documents downloaded from the website of the Ministry of Corporate Affairs, which, according to the Petitioner, indicates that the HUF continues to exist. 4. Since learned Senior Counsel for the parties are ad idem that the matter ought to be remanded to the learned ARC for re-consideration, This is a digitally signed order. The learned ARC shall thereafter reconsider the matter afresh, uninfluenced by any observations contained in the Orders under challenge or by the present Order. Parties, if required, may amend their pleadings and place on record such documents as they seek to rely on. 6. List the present matters before the learned ARC on 16.09.2026 for fresh reconsideration of the matter. 7.
