For Petitioner(s): Mr.K.R.Laxman For Respondent(s): Mr.E.Sundaram Government advocate ORDER With consent on either side, the main Writ Petition itself is taken up for final disposal at the admission stage. 2. This Writ Petition has been filed to direct the Respondents 1 and 2 to direct the respondents 3 to 9 to return the (1) Original 12th Mark Sheet (2) Original UG Mark sheets (3) Original UG Degree Certificate (4)Original PG Provisional, (5) Original PG Mark Sheets, (6) Original PG Degree Certificate, (7) Original 10th Certificate and all other original documents deposited by respective petitioner retained by the Respondents 3 to 9 regarding the Post- Graduation Courses of the petitioner respectively. 3. The brief facts of the case leading to the filing of the Writ Petition are as follows:- The petitioners are all qualified Doctors, who had pursued the Post Graduate Degree (P.G.) in the colleges of the respondents 3 to 9 respectively https://www.mhc.tn.gov.in/judis WP No. 10125 of 2026 __________ Page8 of 12 during the academic years 2022-2025. The petitioners have secured their respective seats in the said colleges on merits by undergoing qualifying examinations. At the time of admission, the petitioners being non-service candidates were required to sign a bond for a sum of Rs.40,00,000/- (Rupees Forty Lakhs only), as per the prospectus, with an undertaking to serve the Government of Tamilnadu for a period not less than two years. In addition to that, the petitioners were directed to submit their original certificates to their respective colleges, as a compulsory pre-condition till the said two year bond gets absolved. However, till date no bond posting were given to the petitioner, though the bond period, which was originally for two years and started its operation from the month of November, 2025, is already over as on 1st week of March, 2026. Hence the petitioners have come up with the present Writ Petition. 4. The learned counsel for the petitioners would submit that neither the petitioners were provided with bond posting nor the petitioners were provided their original certificates, which has been retained by the respondents without any reasons. Further, this Court has already passed several orders to return the original certificates to the persons who have not been given the posting to serve the bond period, thereby pleaded to allow the present Writ Petition. https://www.mhc.tn.gov.in/judis WP No. 10125 of 2026 __________ Page9 of 12 5. On the other hand, the learned Government Advocate appearing for the respondents would submit that as per the Prospectus for admission to Post Graduate Degree / Diploma Courses in Tamilnadu Government Medical Colleges 2022-2023 Session, the petitioners are directed to serve the Government of Tamilnadu for a period of two years from the date of completion of their PG Course and their certificates will be released after successful completion of the bond period of two years. 6. Heard the learned counsel appearing for the petitioners and the learned Government Advocate appearing for the respondents and perused the entire documents placed on record. 7. In view of the submissions made by the learned counsel on either side and that admittedly, the petitioners have completed their P.G.Course during the month of November, 2025 and the respondents have not provided the posting to enable the petitioners to serve their bond period, however, retaining the original certificates / documents submitted by the petitioners at the time of admission to the respective respondents colleges on the ground that the petitioners have not completed the two years of service, as per the bond, without issuing posting orders is unsustainable. https://www.mhc.tn.gov.in/judis WP No. 10125 of 2026 __________ Page10 of 12 8. Therefore, this Court, hereby issues direction to the respondents to issue posting orders to the petitioners and pay them proper stipend within a period of six weeks from the date of receipt of a copy of this order, failing which the respondents 3 to 9 are directed to release the original certificates and documents submitted by the petitioners during the time of admission, as per the prospectus, within a period of one week thereafter, enabling them to acquire job elsewhere. Accordingly, the present Writ Petition is disposed of with the above said directions. No costs. Consequently, connected Miscellaneous Petition, viz., W.M.P.No.10933 of 2026 to permit the petitioners to file a single Writ petition is ordered as prayed for on payment of single court fee and W.M.P.Nos.10934 and 10935 of 2026 are closed.
