JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for respondent Nos.1 to 4. Notice respondent No.5 is not necessary for the following reasons: 2. The petitioner, an ex-serviceman filed an application for grant of agricultural lands under the ex- serviceman quota and the respondent - Tahsildar, Mysore Taluk has issued an endorsement on 29.07.2021 at Annexure-AB stating that no agricultural lands are available in Mysore Taluk and therefore it is not possible to grant any land to the petitioner. However learned counsel for the petitioner draws the attention of this court to Annexure-AD, another representation given by the petitioner on 27.11.2023 where he has stated that in terms of the circular issued by the Revenue Department of the State Government, if lands are not available in Mysore Taluk, then the Deputy Commissioner may consider - 4 - HC-KAR NC: 2026:KHC:15136 WP No. 7754 of 2026 granting land in the neighboring Taluk. Accordingly the petitioner has identified Sy.No.182 of Kupya Village. Kasaba Hobli, T.Narasipura Taluk where 175 acres of land are available for grant in favour of ex-serviceman. 3. The writ petition is accordingly disposed of with a direction to respondent No.2-Deputy Commissioner Mysore District and respondent No.4-Tahsildar Mysore Taluk to re-consider the application of the petitioner in the light of the circular issued by the Revenue Department of the State Government that, if agricultural lands are not available in the Taluk in which the applicant sought for grant, then the Deputy Commissioner may consider grant of land in the neighboring Taluk. Further as noticed herein above, if lands are available in T.Narasipura Taluk as contented by the petitioner, the Deputy Commissioner may consider the same in accordance with law and dispose of the application as expeditiously as possible and at any rate within a period of 2 months from the date of receipt of a copy of this order. - 5 - HC-KAR NC: 2026:KHC:15136 WP No. 7754 of 2026 Ordered accordingly.
