1. This writ petition arises from order dated 23 August 2024 passed by the Central Administrative Tribunal1 in OA 881/2024. The prayer clause in the OA read thus:
“8.1 That this Honourable Tribunal may graciously be pleased to allow the present Original Application set aside the impugned
order dated 11.03.2021 and consequently direct the respondents to refund the recovery of Rs. 490,093 made from the Gratuity of the applicant along with 18% interest.
8.2. That this Honourable Tribunal may graciously be pleased to direct the respondents to restore the basic pay of the applicant at 1 “the Tribunal”, hereinafter. Signed By:PRAMOD KUMAR VATS Signing Date:03.09.2026 11:46:52 Signature Not Verified
W.P.(C) 5441/2026 Rs. 81200/- as initially fixed by the respondents and further direct them to continue and settle all the retirement benefits of the applicant on his correct basic pay of Rs. 81200/- with all consequential benefits.
8.3. That any other or further relief which this Hon'ble Tribunal may be deem fit and proper under the circumstances of the case may also be granted in favour of the applicants”
2. The Tribunal, however, has restricted its consideration and decision, in the judgment under challenge to prayer 8.1 in the OA. There is no consideration of prayer 8.2.
3. As such, learned Counsel for the parties are ad idem agreeable to this writ petition being disposed of by remanding OA 881/2024 to the Tribunal to hear it de novo on prayer 8.2 and to take a decision thereon. Ordered accordingly.
4. For this purpose, both parties are directed to appear before the Tribunal on 14 September 2026. Neither side would be entitled to seek any adjournment before the Tribunal on the date fixed by us.
5. The writ petition is disposed of.
6. We have not expressed any opinion on the merits of the writ petition.
