The petitioners are apprehending their arrest in connection with Complaint Case No.1738 of 2025, for offence registered under section 33(1)(C) of Indian Forest Act and section 27 and 29 of Wildlife Protection Act, pending in court of learned Chief Judicial Magistrate, Chatra. 3. Learned counsel for petitioners submits that false allegations are made of cultivation of poppy plant in the forest land and the petitioners have got no criminal antecedent as disclosed in paragraph no.15 of the petition. He next submits that even the land is not belonging to the petitioners. 4. Learned State counsel opposes prayer and submits that allegations are there of cultivation of poppy plant in the forest land. 5. Considering that the land is of the forest department 2026:JHHC:17777 2 and the land is not belonging to the petitioners and the petitioners have got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to both the petitioners. 6. Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Complaint Case No.1738 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
