JUSTICE ALOK KUMAR SINHA ORAL ORDER 2 13-05-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in connection with Paraiya P.S. Case No. 36 of 2020, registered for the offences punishable under Sections 406, 420, 34 of IPC. 3. The learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated. He is a person of clean antecedent. His name has figured merely on the basis of suspicion. 4. On the other hand, the learned APP for the State has opposed the prayer for bail. 5. From the reading of the FIR, the allegation leveled against the petitioner is that the informant, who is a shopkeeper supplying grains from one place to another, had contacted the

The petitioner is alleged to have sent two trucks for transportation of grains from one place to another. It is further alleged that after loading the trucks, both the trucks did not reach the destination, thereby compelling the informant to lodge an FIR under Sections 406, 420, and 34 of the IPC. 6. The two drivers Pappu Kumar and Anil Kumar, who are co-accused in the case, have already been granted anticipatory bail vide order dated 02.08.2021 passed in Cr. Misc. No. 1253 of 2021. The petitioner is said to be having clean antecedent. Considering all these circumstances, I am inclined to grant privilege of anticipatory bail to the petitioner. 7.
Let the petitioner, as named above, in the event of his arrest or surrender within four weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Paraiya P.S. Case No. 36 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and subject to further condition that :- (i) The petitioner shall co-operate in the investigation/

(ii) The learned Court below would, however, verify the criminal antecedent of the petitioner and in case it is found that the petitioner has concealed his criminal antecedent, the Court below shall take step for cancellation of bail bond of the petitioner.
