Petitioner has filed this writ petition seeking following reliefs. “10.1 This Hon’ble Court be pleased to call the entire records in respect of service record of the petitioner showing continuation of service against the sanctioned and vacant post of Assistant grade III in the Office of the Respondent no. 3. 10.2 This Hon'ble court be pleased to issue a writ of mandamus or other/directions/suitable writs by direct respondent authority/State Government to immediately take a decision on the proposal made by the respondent no 2 & 3 (vide memo dated 14-04-2006, 23-03-2006, 08-02-2007, 05-09-2008, 28-05-2011, 17-01- 2012, 23-05-2013, 05-08-2013, 27-01-2014, 18-06-2015 and 18-03-2021) for regular PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 appointment of the petitioner to the post of Assistant Grade III which is sanctioned against which the petitioner had already worked since 1997 till 2004, particularly when, the similarly situated employees who were appointed along with the petitioner and they have been absorbed and appointed on a regular basis to the post of Assistant Grade - III. 10.3. This Hon'ble Court may pleased to directed the Respondent authority to grant all the consequential benefits from the due date at par with the similarly placed employee who were appointed along with the petitioner for the same job and post and they have been absorbed and appointed on the regular basis. 10.4 Any other relief as deemed fit by this Hon'ble Court. 2. Learned counsel for petitioner submits that petitioner was engaged in the election duty and according to the policy of the State Government the employees who have been engaged in the election duties have been considered for their appointment on regular basis. Some of the similarly situated employees have been given appointment, however, name of petitioner has not been considered. Aggrieved with which, petitioner submitted representation before Respondent No. 3/ Collector on 12.01.2021 which is also not considered and therefore direction be issued to Respondent No. 3 to consider and take decision on the claim of petitioner at the earliest. He also submits that, if permitted by this Court, he will also file fresh comprehensive representation for consideration before Respondent No. 3. 3. Learned State counsel submits that as the petitioner is seeking limited direction to Respondent No. 3 to consider and take decision on the claim/ representation of petitioner, he is having no objection. 4. On due consideration of the submission made by learned counsel for the respective parties, nature of grievance, this writ petition is disposed of permitting the petitioner to submit fresh comprehensive representation before Respondent No. 3 raising all the grounds as raised in this writ petition and if 3 / 3 such a representation is submitted the concerned authority shall consider and take decision on the representation to be submitted by petitioner, in accordance with law, expeditiously preferably within a further period of 06 months from the date of receipt of representation. 5.
