Learned HCGP accepts notice for the respondent – State. 2. This petition is filed under Section 483(1)(b) of BNSS seeking modification of condition No. 1 imposed by the III Additional District and Sessions Judge, Bengaluru Rural District sitting at Anekal in the order dated 19.11.2025 passed in Crl.Misc. No. 5543/2025 by extending time by one week. 3. Heard learned counsel for petitioner and learned HCGP for respondent - State. 4. Petitioner had been granted anticipatory bail in Crime No. 379/2025 of Hebbagodi Police Station by order dated 19.11.2025 passed in Crl.Misc. No. 5543/2025 by - 3 - HC-KAR NC: 2026:KHC:9449 CRL.P No. 1199 of 2026 imposing conditions. One of the conditions imposed, i.e., condition No. 1 reads thus: “The Petitioner shall surrender before the Respondent Police Station within 15 days from the date of this Order. If the Petitioner surrender before the concerned Police, the Investigating Officer shall complete the interrogation as expeditiously as possible, and on completion of the interrogation and recovery of the material objects if any, the Petitioner shall be released on Bail on the terms and conditions in this Order.” 5. Petitioner had not complied the said condition in time. He filed an application seeking extension of time and it came to be rejected by order dated 04.01.2026. Therefore petitioner is before the Court seeking modification of the said condition by extending the time. 6. Petitioner is residing in West Bengal. He had booked air-tickets to travel to Bengaluru on 04.12.2025 by Indigo flight. Due to cancellation of the said Indigo flight, he could not appear before the Investigating Officer to comply condition No. 1. Now petitioner has undertaken - 4 - HC-KAR NC: 2026:KHC:9449 CRL.P No. 1199 of 2026 that he will appear before the Investigating Officer within seven days from this date. 7. Considering the above aspects, petitioner has made out a case for modification of condition No. 1 imposed in the order dated 19.11.2025 passed in Crl.Misc. No. 5543/2025 by extending the time by seven days from this day. 8. In the result, following; O R D E R I. Petition is allowed. II. Time imposed in condition No. 1 in the order dated 19.12.2025 passed in Crl.Misc. No. 5543/2025 is extended by one week from this day. III.
