Also heard Mr. K K Parasar, learned Additional Public Prosecutor, Assam. By this application filed under Section 482 of the BNSS, 2023, the petitioners, namely, (1) Jakir Ahmed Laskar and (2) Rafique Uddin Laskar have prayed for pre-arrest bail in connection with Silchar P.S. Case No. 1140/2025. The informant is the divorced wife of the petitioner no. 1. She has alleged that after divorced, her former husband i.e. the petitioner no. 1 used to send her different offensive messages and photographs for causing inconvenience and annoyance to her. She alleged that the petitioner no. 1 conspired against her so that she may not enter into any marriage. The informant made complaints to the petitioner no. 2 i.e. the father of the petitioner no. 1 but he also did not take any action against his son. I have considered the submission made by the learned counsel for both the sides. This court is of the opinion that for the allegations brought against the petitioners, they do not deserve to be detained in custody. Hence, their prayer for pre-arrest bail is allowed. Accordingly, it is hereby directed that in the event of arrest of the petitioners, namely, (1) Jakir Ahmed Laskar and (2) Rafique Uddin Laskar in connection with Silchar P.S. Case No. 1140/2025, the arresting authority shall release them on bail of Rs.20,000/- each with one surety of like amount to the satisfaction of the arresting authority. The petitioners are directed to co-operate with the Police investigation as and when called for. With the above, the bail application is disposed of. JUDGE Comparing Assistant
