Heard Mr. T.K. Jha, learned counsel for the petitioner. Also heard Mr. N.K. Jaiswal, learned Deputy Govt. Advocate appearing for the State-respondent. 2. The present petition has been filed by the petitioner with the following prayer:- “It is, therefore, prayed that the Hon’ble Court be pleased to allow the petition and be pleased to quash the First Information report dated 23.08.2025 along with the Digitally signed by MOHAMMED AADIL KHAN Date: 2026.02.13 20:24:59 +0530 2 charge-sheet and taking cognizance by learned Add.Session Judge (FTC) Baikunthpur District-Korea on 27.11.2025 proceeding in connection with the crime bearing Crime/FIR No. 0166/2025, session trial no.122/2.25 u/s 64(2)(f), 64(2)(m), 296,351(3), 115(2) of BNS 2023 (Annexure P-1)(colly), in the interest of justice.” 3. From perusal of the petition it transpires that charges have been framed on 10-12-2025 and copy of which has been annexed at page No.67 of the petition by the petitioner, but no prayer for quashing of charges has been made in the petition. 4. In such a situation, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file a duly constituted petition. 5. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs.5,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Government SAA, Koriya, (C.G.). 6.
