1. The Petitioner, as an ex-student of Pattamundai College, is stated to be the President of the said College Students’ Union for the academic year 1994-95 and in the present writ petition, he assails the formation of office bearers for the alumni association of College Pattamundai vide Annexure-4. 2. The relief sought for is extracted hereunder:-
“Under the circumstances stated above, the Petitioner, therefore, prays that the Hon'ble Court be graciously pleased to admit the Writ Application, issue notice to the Opposite Parties and after hearing from the Advocates of the Parties, issue a writ in nature of certiorari or any other suitable writ quashing the notification dated 25.02.2026 vide Annexure-4 and to further issue a writ in nature of Mandamus directing the opposite parties to elect the office bearers of Pattamundai College Alumni Association in a transparent manner within a stipulated period for ends of justice and equity. And/or the Hon'ble Court may pass any other appropriate order/orders, direction/directions as deem fit and proper in the interest of justice. xxx xxx xxx”
3. Responding to the query of this Court regarding maintainability, the Petitioner relies on the following judgments:-
i) Whirlpool Corporation v. Registrar of Trade Marks, Mumbai, AIR 1999 SC 22 p. 3 ii) Radha Krishan Industries v. State of Himachal Pradesh, AIR 2021 SC 2114. 4. On a bare perusal of the recitals of the writ petition, this Court is of the considered view that the relief sought cannot be granted in exercise of the plenary jurisdiction of this Court and the judgments relied on in no way enable the Petitioner to tide over the hurdle of maintainability. Additionally, the Petitioner is seeking quashment of Annexure-4 and admittedly it is apposite to note that the affected persons named therein have not been arrayed as Opposite Parties in this writ petition. On the said count too, the writ petition does not merit consideration. 5. Accordingly, this Court is not inclined to entertain this application. 6. If so advised, the Petitioner may invoke the jurisdiction of common law forum in terms Section 9 of the Civil Procedure Code. 7. The writ petition stands disposed of. No costs.
