Kausik (Rejected) CRM (M) 31 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhadreswar Police Station Case No. 334 of 2025 dated 12.09.2025 under Sections 109/118(2)/126(2)/3(5) of the BNS, 2023. And In the matter of : Sk. Samir ……Petitioner. Mr. Suman Chakraborty ……for the Petitioner. Mr. Anupam Das Adhikary Mr. Asraf Mandal ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 132 days and the investigation have been concluded, further detention of the petitioner is unwarranted. Learned advocate for the State on the other hand submits that there are serious charges so far as the present petitioner is concerned. The injuries as well as the post-mortem report will speak for itself. There are eye witnesses to the incident. Learned advocate for the State on perusal of the case diary submits that there are 4 eye witnesses in the present case and charges are yet to be framed. 2 Having considered the fact I direct the learned Trial Court to expedite the process of framing of the charges. Petitioner would approach this Court after the evidence of the 4 eye witnesses are over. Learned Trial Court is directed to ensure that the 4 eye witnesses are examined within a period of 5 months from the date of framing of charges. However, CRM (M) 31 of 2026 is rejected at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
