JUSTICE V SRISHANANDA ORAL ORDER Learned counsel for the revision petitioner has filed memo which reads as under: “The Petitioner above named most respectfully submits that the petitioner has filed the instant Criminal Revision Petition challenging the Judgment and Sentence of Conviction in CC No. 186/2012 passed by the learned Principal Civil Judge And JMFC Sagar, and as well as the order of dismissal in Criminal Appeal No. 10003/2021 passed by the V Additional District and Sessions Judge Shimoga sitting at Sagar. It is submitted that the Courts below were pleased to convict the petitioner herein for a period of 1year or in the alternative to deposit an amount of Rs. 15,25,000/- (Rs. Fifteen Lakhs Twenty Five Thousands). The petitioner has decided to settle the instant dispute by depositing the fine amount, the petitioner is ready to deposit the fine amount in full within 3 months from today in three equal instalments. - 3 - HC-KAR NC: 2026:KHC:20535 CRL.RP No. 1384 of 2022 The petitioner has deposited a sum of Rs. 3,05,000/- before the Lower Appellate Court while filing the Criminal Appeal, and had paid a sum of Rs. 4,57,500/- pursuant to interim orders passed by this Court on 17/02/2023. Hence in all the petitioner has already deposited a sum of Rs. 7,62,500/- (Rs. Seven Lakhs Sixty Two Thousand Five Hundreds only). Hence now the petitioner has to deposit 7,62,500/-. The petitioner most respectfully pray that this Hon'ble Court to permit the petitioner to withdraw the instant petition by depositing the remaining fine amount of Rs. 7,62,500/- in three equal instalments starting from 10th May 2026. The amount may kindly be pleased to adjust against the decree in COM.O.S.10016/2021 on the file of V Additional District and Sessions Court, Shimogga in the best interest of justice and equity.” 2. Placing the memo on record, revision petition stands disposed of. 3. Amount in the deposit, if any, is ordered to be withdrawn by the complainant under due identification. 4. It is made clear that if there is any default in any one of the instalments of the compensation amount as agreed in the memo, petitioner shall undergo imprisonment as ordered - 4 - HC-KAR NC: 2026:KHC:20535 CRL.RP No. 1384 of 2022 by learned Trial Magistrate, confirmed by the First Appellate Court. 5. After payment of the compensation amount, same shall be adjusted towards the decree passed in Com.O.S.No.10016/2021, on the file of V Additional District and Sessions Court, Shimoga.
