The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus quashing the impugned posting order dated 04.06.2025 as well as rejection order dated 22.07.2025 issued by the respondent No. 6 and appeal rejection order dated 10.09.2025 passed by the respondent No. 5 and also quash surplus list related to the petitioner (Annexure-P/1 to 4) 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to take counselling as (Art) Teacher as per appointment order and also direct to the respondent No. 2 to decide pending representation filed by the petitioner, on 24.09.2025. 10.3 That, this Hon’ble Court pleased to issue a writ in the nature of mandamus directing the respondents to verify surplus list and date of joining of the petitioner and posting order thereafter delete the name of petitioner from the surplus list. 10.4 That this Hon’ble Court pleased to issue a writ in the nature of mandamus directing the respondents allowing the petitioner to work at Govt. Middle School, Kulipota, Block Baloda, District: Janjgir-Champa (C.G.)” 2. At the outset, learned counsel for the petitioner submits that as petitioner had not submitted any representation/appeal before the State Level Committee constituted under the Rationalization Policy, he is not 3 pressing this writ petition on merits and is only seeking permission to submit representation before the concerned authority and direction be issued to the concerned authority to take decision on the representation to be submitted at the earliest. 3. On the other hand, learned counsel for the Respondents/State would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to submit representation before the concerned authority, he is having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, this writ petition at this stage is disposed of permitting the petitioner to submit representation/ appeal before the State level committee, headed by Director of Public Instructions, and if such a representation is submitted by the petitioner, concerned authority shall consider and take decision on the representation to be submitted by the petitioner on its own merits in accordance with law, expeditiously, preferably within a period of 02 months from the date of receipt of representation. 6.
