By way of this transfer petition under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks transfer of three complaints under Section 138 of the Negotiable Instruments Act, 1881, which are pending before JMFC-02(NI Act), South District. Saket Court Complex, New Delhi; JMFC-11 (NI Act), South District, Saket Court Complex, New Delhi and JMFC-03(NI Act), Central District, Tis Hazari to the Court of JMFC-09 (NI Act) Central, Tis Hazari Courts, where two prior complaints between the same parties are pending. 2. 3. Mr. Vikas Sharma, learned counsel for the petitioner, submits that all five complaints arise out of the same set of business transactions between the parties. He, therefore, seeks that the said matters be clubbed and tried by a single Court. 4. Pursuant to notice issued vide order dated 22.05.2026, Mr. A.V. Shukla, learned counsel for the respondent, has entered appearance, and states that the respondent has no objection to the relief sought. 5.
Having regard to the fact that the complaints are between the same parties and arise out of the same set of business transactions, the petition is allowed, and it is directed as follows: a. CC NI Act/2104/2025 and CC NI Act/4445/2025 pending before the Saket Courts, South District, Delhi, are transferred to JMFC-09 (NI Act), Tis Hazari Courts, Central District, Delhi. b. CC NI Act/10181/2025 pending before JMFC-03(NI Act), Central District, Tis Hazari Courts, Delhi, is transferred to JMFC-09 (NI Act), Tis Hazari Courts, Central District, Delhi. List before the Chief Judicial Magistrate, Tis Hazari Courts, Central District, Delhi, on 16.09.2026, for further directions. 7. The petition is disposed of in terms of the above.
