THE CIRCLE INSPECTOR OF POLICE, PARVATHIPURAM RURAL, PARVATHIPURAM, MANYAM DISTRICT.535501 3 Dr. YLR, J W.P.No.8801 of 2026 Dated 06.04.2026 ...RESPONDENT(S): Counsel for the Petitioner(S): Y ANUPAMA DEVI Counsel for the Respondent(S): GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a Writ Order or Direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents unauthorized calling the petitioners to the Police Station and threatening them for getting statements in their favor without having authority without following due procedure of law as illegal improper unjust arbitrary and unconstitutional Violation of Article 14 16 20 and 21 of Constitution of India….” 2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader. 3. Smt. Y. Anupama Devi, learned counsel for the petitioners, submits that the petitioners, who are working as teachers, have been called by the respondent police unauthorizedly and threatened them to give statements as per their wish. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the Inspector of Police, Parvathipuram Rural Circle, has received an NRC petition vide C.No.118/G1/Pet/Genl/2026, dated 18.02.2026, from the Superintendent of Police, Parvathipuram, which 4 Dr. YLR, J W.P.No.8801 of 2026 Dated 06.04.2026 was endorsed by the Assistant Superintendent of Police, Parvathipuram, to respondent No.6 with instructions to conduct enquiry and submit a report within three days. The District Educational Officer, Vizianagaram, alleged that certain irregularities were committed for claiming of salaries in RCM Aided Schools, Parvathipuram, and requested to initiate criminal action against the Management/Correspondents/staff of 13 RCM Schools, Parvathipuram, who have submitted false information and misled the Educational Department. 5. It is further alleged that 13 teachers, who were working in RCM Aided Schools from 2003 at various places, indulged in misappropriation of Government funds to the tune of Rs.4.04 Crores, based on the enquiry reports of the enquiry officers, namely, the Sub-Collector, Parvathipuram, and the Regional Joint Director of School Education, Visakhapatnam. The above conclusions were drawn, and it was urged by the District Educational Officer to initiate criminal action against one Dr. A. Innayya, Management of Diocese of Srikakulam, and Father P. Jaipal, Correspondent, and the 13 teachers who have issued fake duty certificates to certain teachers and also recorded false entries in the attendance registers by resorting to fraudulent methods. 6. It is submitted that to conduct preliminary enquiry, only the petitioners were called to the police station. The petitioners were neither harassed nor threatened by respondent Nos.3 to 6. The learned Assistant Government 5 Dr. YLR, J W.P.No.8801 of 2026 Dated 06.04.2026 Pleader further submits that the petitioners have not cooperated with the enquiry officer. 7. Considering the entire facts and circumstances of the case, the Writ Petition is disposed of directing the petitioners to cooperate with respondent Nos.3 to 6 in recording the statements and to enable submission of a report as directed by the District Educational Officer. Respondent Nos.3 to 6 are directed not to harass or adopt any coercive methods while recording their statements. In this regard, the petitioners are permitted to engage a counsel while recording their statements before the enquiry officer of the police department. The advocate shall not interfere in the process of the enquiry. 8. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
