1. By way of the present bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [“BNSS”], the petitioner seeks regular bail in connection with FIR No. 538/2025 dated 12.08.2025, registered at Police Station Begum Pur, Delhi, under Sections 64(1)/351(3) of the Bharatiya Nyaya Sanhita, 2023 [“BNS”], and Section 4 of the Protection of Children from Sexual Offences Act, 2012 [“POCSO Act”] [“subject FIR”].
2. At the outset, Ms. Manjeet Arya, learned Additional Public Prosecutor for the State, points out that the subject FIR includes an offence under the POCSO Act and that the minor victim as well as the complainant are yet to be examined as witnesses.

BAIL APPLN. 3645/2026 petitioner, seeks permission to withdraw the present bail application, with liberty to approach the learned Sessions Court at an appropriate stage, including in the event there is any inordinate delay in recording the evidence of the minor victim and the complainant.
4. The bail application, alongwith the pending application, is accordingly dismissed as withdrawn, with liberty as aforesaid.
5. It is clarified that this Court has not expressed any opinion on the merits of the case, and all rights and contentions of the parties are left open to be urged before the learned Trial Court in accordance with law.
