1. Present petition has been filed for compounding of offence. The opposite party no.2 had filed a complaint under Section 138 of the Negotiable Instrument Act. The court of learned Judicial Magistrate, 3rd Court at Malda found the petitioner guilty and awarded simple imprisonment for three months and a fine of Rs.7,50,000/-. This order was challenged before the learned Additional District & Session Judge, 5th Court, Malda and vide order dated 29th November, 2021 the appeal was dismissed.
2. Pursuant thereto the present CRR 1137 of 2024 was filed before this court. However, during pendency of this petition both the parties have agreed to amicable settlement and the opposite party no.2 complainant is stated to have received the entire amount of Rs.7,50,000/- and therefore, both the parties state that the matter may be compounded. The application is duly been accompanied with an affidavit of both the parties.

3. Since both the parties have compounded the offence voluntarily without any fear or coercion the compounding is allowed.
4. The petition stands disposed of in terms of the compounding. ( Dinesh Kumar Sharma, J. )
