The petitioners are before this Court calling in question proceedings in C.C.No.51274/2026 registered for the offences under Sections 115(2), 351(2) and 352 read with Section 3(5) of the BNS, 2023. 2. counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the affidavits. The affidavits read as follows:
“AFFIDAVIT
We, 1) Mrs.Shilpa Kumari, W/o. Anurag Verma, Aged About 34 years, R/at No.4113, 11th Floor, Tower-4, Habitat Eden Heights, Near Hoodi Metro Station, Hoodi, Bangalore 5600482) Mr. Ashutosh Kumar Srivastava S/o Dinesh Kumar, Aged about 36 years R/at No.402, SJR Verity, Kasavanahalli, Old Jail Road, Opp Ratandeep Market, Bengaluru 560035 3) Mr. Ankit Rajesh Kumar Verma S/o Rajesh Kumar Verma, Aged about 28 years R/at Srinivas Reddy Layout Road, AECS layout, A Block, Brookfield, Bengaluru 4) Mr. Biswanath Prasad S/o Late. Rajeswar Prasad, Aged about 61 years R/at No.402, SJR Verity, Kasavanahalli, Old Jail Road, Opp Ratandeep Market, Bengaluru 560035 5) Mrs. Anitha Prasad W/o Biswanath Prasad, Aged about 57 years R/at No.402, SJR Verity, Kasavanahalli, Old Jail Road, Opp Ratandeep Market, Bengaluru - 560035 do hereby solemnly affirm and state on oath as follows. 1. We state that, we are the petitioners in the above case and we know the facts and circumstances of the case. Hence we are swearing to this affidavit. 2. We state that the Petitioner No.1 viz., Shilpa Kumari and Respondent No.2 are Husband and wife. The other Accused/petitioners herein are relatives of 1st petitioner viz., Shilpa Kumari. 1st Petitioner's marriage with the 2nd Respondent was solemnized in accordance with traditional Hindu rites and customs on 16/7/2021 at Hotel Kalchuri,

Jabalpur, Madhya Pradesh. Out of the wedlock they have twin daughters and who are aged 3 about years now. 3. We state that after marriage 1st Petitioner viz., Shilpa Kumari and Respondent No.2 have moved to Bengaluru and are permanent residents of Bengaluru. 4.
We state that due to temperamental differences and misunderstandings, disputes arose between 1st Petitioner viz., Shilpa Kumari and Respondent No.2, as a result a complaint dated 31-05-2025 was filed by her against the Respondent No.2 before the Whitefield Women Police Station, Bangalore to leading FIR No.43/2025 dated 31-05-2025 at Whitefield Women Police Station, Bangalore for offences punishable under Sections 85 and 115(2) of BNSS, 2023. Pursuant thereof, the Whitefield Women Police Station, Bengaluru have filed a charge sheet in C.C.No.65228/2025, on the file of XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru implicating the Respondent No.2 herein for the aforesaid alleged offences. 5. We state that the Respondent No.2 herein due to misunderstanding lodged a complaint dated 24/9/2025 against the Petitioners herein before the Mahadevapura Police Station, Bengaluru. However, due to the inaction on the part of the 1st Respondent Police, the 2nd Respondent herein filed a Private Complaint in PCR No.56919/2025 before the XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru. On 22/9/2025 the XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru. Upon the PCR No.56919/2025 filed by the 2nd Respondent herein, the Hon'ble trial court referred the matter to 1st Respondent Police for investigation under section 156(3) of CrPC and to submit report thereof. Pursuant thereof, the 1st Respondent Police registered an FIR No. 614/2025 dated 24/9/2025 at Mahadevapura Police Station, Bengaluru for the offences punishable under sections 115(2), 351(2) and 352 R/w 3(5) of The Bharatirya Nyaya Sanhita (BNS), 2023. Subsequent thereto, 1st Respondent Police viz., the Mahadevapura Police Station, Bengaluru have filed a chargesheet in C.C.No.51274/2026, on the file of XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru implicating the Petitioners herein for the aforesaid alleged offences. - 6 -

We state that the Petitioners and the Respondent No.2, with the intervention of elders and well-wishers, in our own interest and in the interest of the children of 1st Petitioner viz., Shilpa Kumari and Respondent No.2, have now resolved all our differences,

We state that the 1st Petitioner viz., Shilpa Kumari and Respondent No.2 have decided to save our marriage and have already started to resume living together as husband and wife under one roof and other Petitioners have resumed their cordial relationship being relatives. 8. We state that and other Petitioners and Respondent No.2 have no grievances against each other and their respective families in any manner. Hence both do not intend or wish to pursue the complaint and pursuant FIR and prosecution arising out of the same. Further in the interest of the entire family and children 1st Petitioner viz., Shilpa Kumari and Respondent No.2, have reconciled marital life with a resolve to stay together. Since the Petitioners and Respondent No.2 have amicably settled the differences continuation of the proceedings against the Petitioners would not serve the ends of justice and would be an abuse of process of law. Wherefore, we pray that, this Hon'ble Court may be pleased to permit the Petitioners and the Respondent No.2 to compound the offences consequently, quash the proceedings in C.C.No.51274/2025, on the file of XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru arising from Crime no. 614/2025 of Mahadevapura Police Station, Bengaluru for the offences punishable under sections 115(2), 351(2) and 352 R/w 3(5) of The Bharatirya Nyaya Sanhita (BNS), 2023, against the Petitioners, on a complaint filed by the Respondent No.2, in the interests of justice. I state that after marriage me and 1st Petitioner have moved to Bengaluru and are permanent residents of Bengaluru. 4. In the light of application for compounding being filed along with the affidavits and offences not being against the State, I deem it appropriate to accept the compounding application filed along with the affidavits and terminate the proceedings against these petitioners in the subject petition. 5. For the aforesaid reasons, the following:
ORDER (i) Criminal Petition is disposed. (ii) Proceedings in C.C.No.51274/2026 pending before the XXIX Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru, stands quashed qua these petitioners.
