The petitioners are apprehending their arrest in connection with Lawalong P.S. Case No.5 of 2026, for offence registered under section 18, 27(a), 28, 29, 30 of NDPS Act, pending in court of learned Sessions Judge Cum Special Judge, NDPS Cases, Chatra.

Learned counsel for petitioners submits that false allegations are made against the petitioners of cultivation of poppy plant in the forest land. He next submits that the petitioners are the poor villagers and only on suspicion the name of the petitioners has been inserted in the FIR. He submits that co-accused persons have been granted anticipatory bail by the Coordinate Bench in ABA Nos.2302 of 2026 and 2442 of 2026.

4. Learned State counsel opposes prayer and submits that allegation of cultivation of poppy plant in the forest land is there.

Considering that the name of the person who has taken name of the petitioner has not been disclosed in the FIR and further the land is of the forest department and is not belonging to the petitioner and the co-accused persons have been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Sessions Judge Cum Special Judge, NDPS Cases, Chatra, in connection with Lawalong P.S. Case No.5 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
