The present writ petition has been filed seeking a direction to the respondent no.1/MCD to inspect the property of the private respondent no.3 and restrain the said respondent from carrying out unlawful demolition and construction work in House no.3C/40, New Rohtak Road, Delhi (‘subject property’), which is adjoining the petitioner’s property. 2. A status report has been filed yesterday, i.e., 1st September, 2026. 2.1. Copy of the same is not on record. This is a digitally signed order. In terms of the aforesaid status report, the subject property has been inspected. An advisory has been issued to private respondent no.3 on 7th July, 2026 with regard to the demolition work being carried out by the said respondent. 4. It is also stated that as per the inspection, no cracks are visible in the property of the petitioner. However, some seepage marks have been noticed on the roof and walls of the petitioner’s property. 5. Counsel appears on behalf of private respondent no.3 and submits that right now, the subject property is in the process of being demolished. He further submits that no construction shall be carried out till the time the sanctioned plan is received from respondent-MCD. 7. In terms of the status report, the stand of the respondent-MCD is clear that no approval is required for carrying out demolition of the property. 8. If the petitioner has any grievance with the damage to the property pursuant to the demolition exercise being carried out, the petitioner would be free to invoke appropriate remedies available in law. 9.
